Protecting Health Data under DISHA: A case for COVID 19.

In current times, data pertaining to digital health has become extremely critical to manage. The Covid-19 pandemic has accelerated the processing of health data. This gives way for privacy and processing concerns.

The government of India had introduced the Digital Information Security in Healthcare Act (DISHA Bill) which never saw the light of day as MEiTY said that they were in the process of introducing another legislation pertaining to confidentiality of digital data applicable across all sectors, which likely to be different than the Personal Data Protection Bill, 2019 (PDP Bill).

The PDP Bill, 2019 is a generalised data protection law, however, the privacy concerns must be acknowledged and considered upon the sector-specific requirements.

On numerous occasions, the data pertaining to patients of Covid-19 has been leaked and shared through messaging apps. Such practices should be deemed unlawful.

We have also given a comment on the use of blockchain and how it eases the process of collecting digital data while remaining transparent and compliant with regulations.
